Payment Terms and Conditions
The Maldives Integrated Foreign Placement System (MiFPS) is a digital platform designed to manage the employment process for migrant workers. It helps the Ministry of Homeland Security and Technology (MOHST) in the Maldives to oversee worker recruitment, processing, and monitoring by automating workflows and improving efficiency standards.
By using services from Maldives Integrated Foreign Placement System (“MiFPS”), you agree to the following payment terms and conditions:
General
We reserve the right to modify these payment terms at any time. Any changes will be posted on this page, and your continued use of our services constitutes acceptance of the updated terms.
For explanation of MiFPS policy, use, and process of your personal data, please read the Privacy Policy. By accessing and using this page, you hereby consent and agree to the terms specified in the Privacy Policy with respect to our processing of your personal data. If you do not consent to the said terms, kindly contact us at the contact details provided in the Privacy Policy.
Pricing
All prices for services are listed in United States Dollars (USD) for transactions processed within or outside Maldives jurisdiction.
These fees may be revised by mutual written agreement with the Ministry, with updates published in the Payment Terms prior to implementation.
Currency conversion to Maldivian Rufiyaa (MVR) shall apply at prevailing rates for domestic processing. Any fees related to currency conversion or international transfer shall be the responsibility of the Payor. We shall not be liable for discrepancies arising from exchange rate fluctuations.
Any applicable taxes, fees, or charges will be clearly indicated during the application process and calculated at checkout before payment is made.
Payment Methods
We accept all major debit and credit cards i.e., Visa and Mastercard.
To make payment, you must have a valid credit or debit card. Please note that payment requests may be declined under the following circumstances:
- The card has expired or is not authorized for international or online transactions.
- The issuing bank declines the transaction.
- The payment is flagged by our system or payment gateway for potential fraud or security concerns.
- The transaction does not meet verification or validation requirements (e.g., incorrect billing information).
By proceeding with a payment, you confirm that the information provided is truthful and accurate, that you are an authorized user of the credit or debit card being used, and that sufficient funds are available to complete the transaction.
Payments will be processed securely through a linked payment gateway, directly handled by the bank using Secure Socket Layer (SSL) technology. Please rest assured that we do not have access to your credit or debit card details.
Late Payments and Failed Transactions
If your payment transaction is declined or fails, we will notify you and attempt to process the payment again. If the payment is not successfully made within a stipulated period, we reserve the right to suspend or cancel the services.
Chargeback Pre-emption and Legal Resources
Users agree to exhaust all internal resolution mechanisms provided by MiFPS prior to initiating any chargeback request with their financial institution. Failure to do so constitutes a breach of these Payment Terms and Conditions. MiFPS reserves the right to suspend services, terminate accounts, and pursue legal remedies – including recovery of administrative costs and damages – arising from unauthorized or premature chargeback actions. This clause shall override any conflicting representations and survive termination of service.
Refund Eligibility and Audit Protocol
All payments made via the MiFPS platform are strictly non-refundable, except in cases of (i) duplicate transaction confirmed by the payment gateway, or (ii) system error resulting in non-delivery of service. Requests for refund must be submitted in writing within ten (10) calendar days of the transaction, accompanied by gateway-issued transaction logs and service non-fulfillment evidence. MiFPS reserves the right to audit all refund requests and reject any submission lacking verifiable documentation. This clause shall override any conflicting refund representations and survive termination of service.
Billing Information
By proceeding with a payment, you acknowledge your responsibility to provide accurate, complete, and up-to-date billing information, including your full name, address, phone number, and valid payment details. It is also your duty to ensure this information remains current to facilitate the smooth processing of your payments.
We strongly recommend that you retain a copy of payment transaction records and review the applicable policies and rules governing the payments. Keeping transaction records ensures transparency and facilitates dispute resolution if needed. For billing inquiries, please contact us at: +960 123 4567 or email to [email protected]
Affirmative Acceptance and Transaction Record Retention
Prior to completing any payment, users are required to affirmatively accept these Payment Terms and Conditions via a timestamped digital acknowledgment mechanism. MiFPS shall retain transaction records, including acceptance logs, billing details, and payment metadata, for a minimum of seven (7) years to ensure regulatory compliance, dispute resolution, and audit traceability. This clause shall survive termination of service and override any conflicting retention representations.
Governing Law and Data Protection Override
Notwithstanding any reference to the jurisdiction of Maldives, all disputes, data processing activities, and regulatory compliance obligations arising from or in connection with these Payment Terms shall be governed by and subject to the laws of Malaysia, including the Personal Data Protection Act 2010 as amended by the Personal Data Protection (Amendment) Act 2024 (“PDPA”), where the Maldives lacks an equivalent enforceable data protection framework. This includes compliance with mandatory breach notification, appointment of a Data Protection Officer, and recognition of biometric data as sensitive personal data. This clause shall override any conflicting provisions and survive termination of service or cessation of platform use.
Merchant Outlet Jurisdiction and Cross-Border Transactions
All payments processed via the MiFPS platform are deemed to occur within the jurisdiction of Maldives. However, where services are accessed or utilized outside of Maldives, or where users reside in jurisdictions with conflicting consumer protection or payment regulations, MiFPS shall apply the governing law override as stated herein and shall not be liable for any regulatory inconsistencies arising from cross-border use. This clause shall override any conflicting representations and survive termination of service.
Disclaimer on Future Amendments
MiFPS reserves the right to amend its Payment Terms and Conditions in response to evolving legal, regulatory, or operational requirements, including but not limited to changes in data protection laws, payment mechanisms, jurisdictional scope, or integration with third-party platforms. Users are advised that continued use of the platform constitutes acceptance of any such amendments, and MiFPS shall not be liable for non-compliance arising from outdated or unacknowledged terms.
